Terms and Conditions of Use

Total Print Solution (“we”, “our”, or “us”)

These are the terms and conditions under which we are willing to engage with you. Any variations must be in writing and approved by us.

1. Your Acknowledgement

You acknowledge your agreement with these Terms and Conditions by engaging with our services or buying our products.

​

All services and sales are provided on these terms and conditions only. Prior interactions or arrangements do not alter or override these terms.

2. Privacy Policy

​

We are committed to safeguarding your privacy. Any personal information we collect is used solely to provide and improve our services.

 

What information do we collect and how is it used?

  • When you engage with us, we may collect your name, email address, and relevant contact details to facilitate communication and service delivery.

  • Occasionally, we may use your information to notify you about important updates or relevant service information.

 

How do we protect your information?

​​

  • We use secure technologies to protect your data from unauthorized access. All personal information is stored securely.

​

3. Return or Exchange of Goods

​

We will gladly refund or credit supplied faulty goods returned within 7 days provided the goods are in original condition, current version and not a special order, hardware, peripheral or clearance item. Otherwise, we will make our best effort to arrange exchange with the manufacturer or accept the goods back for resale.

​

Please note that where the plastic seal or shrink wrap of packaging is broken the return or exchange cannot be accepted due to copyright and licensing restrictions unless faulty or defective. In this case we will help you obtain a working copy. Also "special order" goods are goods that are not in stock at the time of an order and therefore especially ordered to meet your order.

​

Return or exchange of computer hardware and peripherals is sometimes not possible due to third party constraints on us (unless faulty).

​

Right of refusal for the return or exchange of products is at our discretion, except where the Trade Practices Act of Australia makes allowance.

​

There is no return for change of mind or circumstances.

​

A restocking fee of 20% within 7 days will be charged on all return goods, which are not faulty. No refunds after 7 days of purchase. All discrepancies with your purchase must be notified within 24 hours.

​

Any incorrect, missing or damaged items received must be reported to us within 24 hours of you receiving the delivery. (Please quote the invoice number for reference).

​

Refunds for some items will be at the current market price - not at the original purchase price. This is due to rapid depreciation of computer part costs.

​

There will be no credit given on order price difference, due to price drops. Please select carefully at the time when you place your order.

​

All returns or incorrectly invoiced stock items must be returned “un –opened’ and in new condition with no writing, sticky tape or any form of labels or marking on them, or the credit will be denied. And stock returned at your expense (NO EXCEPTIONS).

​

Freight on returns will not be paid for by us unless we are at fault.

​

4. Revisions of Terms of Use

​

We may amend these Terms of Use at any time at our discretion by posting updated terms. Your continued use of our services indicates your acceptance of any changes.

5. Warranty

​

All products sold by us may be covered by the manufacturers' warranty that accompanies the product. Please refer to product manuals enclosed with your purchased product. We make no additional or independent warranty. We do not warrant the performance, compatibility, integrity, merchantability and fitness for a particular purpose of any product but merely pass through to you whatever end-user warranty the manufacturers or software publishers provide with their respective products. The policies and conditions are set by the manufactures and are varied from time to time without notice; We have no control over these products. Proof of purchase is necessary for the warranty claim.

Please note: Due to restrictions placed upon us by the manufacturers, hardware that is defective on arrival can generally be exchanged if we are notified within 7 days of invoice. Otherwise, the manufacturer's warranty process must be followed.

6. Service Delivery

​

We place great importance on the fast and reliable delivery of your orders, however, please note that delivery times are estimates only and we shall not be liable for delays.

 

If you fail or refuse to take delivery of the goods, then in addition to all our other rights and remedies, you shall be liable for all loss and damage (including consequential loss and damage) suffered or incurred by us as a result thereof and we, at our discretion may charge a restocking fee of up to 20% of the purchase price. Anyone at the delivery address who receives the goods will be presumed by us to be authorized to receive the goods. Once the goods are delivered to you, it is your responsibility if they are lost or damaged.

 

The goods shall be at your risk at the point of delivery. You, upon taking delivery of the goods, shall immediately examine the goods and give written notice to us of any defect within five (5) days of such date, failing which the goods shall be deemed to have been delivered in good order and condition and accepted by you.

7. Engaging Our Services

​

By engaging our services, you agree to the pricing, scope, and terms set at the time of confirmation. Payment terms are stated on the invoice or unless otherwise agreed in writing.

8. Disclaimer of Liability

​​​

To the extent permitted by law, we will not be liable in contract, tort (including negligence) or otherwise, for any direct, indirect, special, consequential or punitive loss or damages or any loss or damages whatsoever, including (but not limited to) loss of use, data, or profits, arising out of or in connection with:

​

  • Goods or services supplied by us under these Terms of Use.

  • A failure or omission on our part to comply with obligations under these Terms of Use.

  • Any advice, recommendation, or information provided by us, whether oral or written, unless expressly stated otherwise in writing.

 

 

9. Title of Goods

​

The goods shall remain our sole and absolute property as legal and equitable owner and you shall hold such goods as bailee only until such time as you shall have paid the full price. You shall be liable to us in respect of any loss or damage to the goods during such bailment.

​

​

10. Payment Terms

​

The price shall be paid by you in full without any deduction in respect of any claimed set-off or counterclaim (including any such set-off or counterclaim on account of any delay on the part of us in delivering any part of the goods) on or before the payment date.

​

Payments must be paid in full and funds must be fully cleared prior to the title of good is passed onto the customer.

​

Payment options are direct deposit, PayPal, direct Internet transfer, credit card (VISA/MARSTERCARD/AMEX), bank cheque or business cheque. In addition to any other rights or remedies in the event of your default hereunder, we shall be entitled:

​

To charge and recover costs incurred for the collection of payment (such as but not limited to collection agency fees and legal costs), cheque dishonour fees, interest at the current bank overdraft rate plus 10% per annum from the due date for payment until payment in full;

​

To immediately and without notice retake possession of the goods (and for such purpose you irrevocably license us, our employees, contractors, servants or agents to enter upon the premises at which the goods are located to so retake possession) and resell the goods after seven (7) days written notice to you and thereafter recover from you any amount by which the resale price is less than the price agreed to be paid by you, together with all costs and expenses suffered or incurred by us as a result of your default;

​

  • At our sole discretion charge a restocking fee of up to 20% of the purchase price.

  • Please print your order or quote ID on the cheque.

  • We DO NOT process credit cards sent via emails or from overseas customers. Please do not call us to give us your credit card details, we will contact you once your details and the order has been confirmed. Your contact details must be verifiable and contactable on the same listed number; otherwise you'll be required to fax/scan the credit card and identification card. We do not accept third party shipping, where the goods are delivered to someone else other than the customer (if it is sent to work address, then provide company detail and contact details). Please make sure you give us correct details which will speed up the verification process.

 

 

11. Pricing Policy

​

All fees and charges are subject to change without notice. Prices quoted exclude applicable taxes unless stated otherwise. We strive to maintain accurate and fair pricing but reserve the right to correct any errors or revise charges where necessary.

12. Limitation of Liability

​

We shall under no circumstances be liable for special, incidental, or consequential damages including loss of profit or opportunity, even if we have been advised of the possibility of such damages; the maximum liability for all direct damages, if any, arising out of any action shall be limited to an amount not to exceed the purchase price of the product.

​

Subject to any applicable Commonwealth or State legislation, our liability for any such breach shall be limited, at our sole discretion, to any of the following:

​

  • Replacement of the goods or any part thereof;

  • Supply of equivalent goods or any part thereof;

  • Repair of the goods or any part thereof;

  • Payment of the cost of replacing the goods or acquiring equivalent goods or any part thereof;

  • The payment of the cost of having the goods or any part thereof repaired; or

  • Refund of the goods upon return.

 

 

13. Jurisdiction

​

All engagements with us are deemed to take place in Solomon Islands. Any disputes must be resolved under Solomon Islands law, with jurisdiction in the relevant Solomon Islands courts.

14. General Provisions

​

In the event any section or portion of a section of these Terms and Conditions of Sale are deemed unlawful or unenforceable, that section or portion of a section shall be stricken from the Terms and Conditions of Sale, and the remaining terms shall continue in full force and effect.

15. Changes to Terms

​

We reserve the right to update or change these terms at any time. It is your responsibility to review them regularly.
